RECOMPASS X NABIS DONATIONS
SB 34, also known as the Dennis Peron and Brownie Mary Act, enables cannabis companies to donate their excess or soon-to-expire products to medical patients without facing any tax liability. This not only helps medical patients access much-needed medicine, it also allows brands to avoid costly disposal fees while making a positive impact in their communities through compassion giveback programs.
WHAT CAN BE DONATED
Products that comply with the necessary packaging, testing, and labeling regulations for medical and adult use sales in CA can be donated to medical patients. These donations are tracked and traced through Metrc the same as non-donated products, but will be flagged as donation in Metrc and no longer incur tax.
Each month, Nabis will provide a notice to brands flagging any on-hand inventory that is due to expire within 90-days.

If you are unable to sell these products to a retailer and/or the products are past their expiration or best by date, Nabis can facilitate a destruction event for these items in accordance with DCC regulations and will charge a fee of $.25 per unit (on average) along with a $170 per destruction event.

If the products are not yet expired, you can choose to donate them to medical cannabis patients through SB 34 by reaching out to our preferred donation management company, ReCompass (see below).

PLEASE NOTE: Products must be “sold” (donated) to patients through a licensed retailer prior to the expiration date on the product.
